GCADA’s Legal Advisory Services (LAS) Program
GCADA staff members include on-site attorneys who have worked with or in the automobile industry for over 20 years! As a result, one of the most utilized benefits of GCADA membership is the legal representation provided through GCADA’s Legal Advisory Services Program (LAS Program). The LAS Program allows for covered legal services at no charge to member dealers, with representation provided by GCADA’s uniquely qualified legal staff. This benefit makes us stand out from the rest.
GCADA Legal Staff advises dealers on a daily basis regarding consumer and regulatory matters. Specific legal representation is also provided for those inquiries and demands from consumer counsel regarding issues involving consumer-based claims, including those alleging Consumer Sales Practices Act, odometer and breach of warranty violations.
These cases typically involve claims by plaintiff’s counsel that if left unresolved may lead to the dealership being named in a lawsuit as a Defendant or Third Party Defendant. The LAS program also provides legal representation in consumer-based claims where the dealership has been named as a Defendant in a Small Claims Court action (small claims cases have a jurisdictional damages limit of $3,000 or less). The LAS Program includes the following services:
- Small Claims Case Representation
- Consumer Transaction Review
- Release Drafting
- Subpoena/Document Review
- Dealer Litigation Review/Consulting
- Advertising Review Compliance
The LAS Program allows for covered legal services at no charge to member dealers.
